Infolinks Advertising Agreement Terms

Various in-text link advertising programmes are available online. What do they do in real? They links the ads which are hidden in the selected texts in posts in a blog or website and only pops up when the mousepointer hovers the link. The publisher or the webowner gets money from the ads by valid impressions of a particular number and also valid clicks made by bonafide visitors. Now as a connecting link, the advertising company or network also gets a share. As a provider of space for planting these ads, the publisher will get more than half share from these ads. Thus anyone will love to join such scheme as it is less space consuming when the page loads. One such advertising network is Infolinks which is a Delaware Corporation. It helps you earn some dollars for your hardwork by placing some ads in link formats.
When you join the programme offered by infolink you are supposed to enter into an agreement which is termed 'Infolinks Publisher Agreement'. This agreement describes the terms and conditions, the rights and liabilities of both the publisher and the advertising network. As I personally has a blog supported by this Advertiser, I will not discuss all the terms and conditions as such as I have a contract in that regard. But I will discuss in this post the major rights and liabilities of both the parties to the agreement. Both parties are controlled by the terms of this agreement. As it is a Delaware Corporation, the governing law is the one in Delaware.
Rights or Powers of the Publisher
The website owner is the publisher in this agreement who enters into the agreement with the corporation. This scheme provides revenue reports which shows daily, weekly, monthly status of your earnings in dollars. Besides this the publisher can view the net impressions of advertisements, total clicks, etc. Now as per the terms of this agreement a publisher gets some added rights with regard to the revenue statement. The publisher can review a finalised revenue statement of his earnings for the immediately preceding month.
Duties or Liabilities of Publisher
Earning the dollars must be properly taxed. You will have to provide a tax statement when you join the scheme. As per the agreement the publisher is responsible for paying the taxes. He is also liable for any penalties which may arise in this regard. So please make sure that the dollars are properly taxed.
Powers Rights of Infolinks
Comparing with the Publisher, the corporation has more rights as it appears from the agreement. One question arises in every publisher's mind. Do we have a say in the amount of money we get from the ads? No ad network will probably give such a power to the publisher. However we can make sure that it is more than half. But the ultimate power vests with the corporation to fix the percentage of share. Dont get worried. It's always more than half unless no company will be bloggers' favourite. Another thing to be noted is that as in the case of Adsense and many other networks, this corporation also pays for qualified clicks made by genuine and bonafide users or visitors. If you use any bad methods to create a click and earns money and later the corporation detects it somehow, the corporation has every right and power to credit back the amount so earned.
The business conditions and the market conditions may require the corporation to reduce or increase the percentage of money to be paid to each publisher. This may be narrated as a right given to the corporation.
Duties Liabilities of Infolinks
It is a happy thing that the corporation plays the role of a responsible party. It binds itself with certain responsibilities by way of the agreement. As the corporation has a right to adjust the percentage of revenue, it has to give a notice to the publisher in that regard. You may refer the original agreement to know the correct percentage.
Common rights
Apart from the above there are certain common rights shared by the parties. Both parties can at their will make an end to the agreement by giving prior notice in case of a violation of material terms of this contract. However the right to take legal action is reserved.
Conclusion
No online ad network will assure you of any certain sum of money by using these advertisements. The same is the case of this corporation. Every money is hard-earned and there is a satisfaction in it. The revenue depends on the content oriented ads, their value, the targeted location, placement of ads etc. Let us hope for the best. It seems that the agreement is fair enough to act upon. One can safely enter into the legally binding agreement as no extra burden is laid upon the publisher to continue with the contract. Some may feel the terms a bit hard to digest. But in my knowledge, the agreement is open, free and is 100% safe if you as a publisher do not use any unfair methods and play fraud in dealing with the corporation. Your money is also safe. Now we can start making some dollars.
